The National Association for the Advancement of Colored People (NAACP) has filed a federal lawsuit against xAI, the artificial intelligence (AI) company founded by Elon Musk. The organization alleges that xAI violated environmental law by operating gas-powered turbines without proper permits near Memphis, Tennessee. The complaint targets emissions tied to the company’s data center operations, raising concerns about air quality and public health in surrounding communities.

xAI Faces Allegations Over Unauthorized Emissions
According to the lawsuit, xAI and its subsidiary installed and operated 27 turbines between August and December 2025 without securing required air permits. The NAACP claimed that the equipment released pollutants linked to smog and fine particles, which can contribute to respiratory issues and other health risks.
The group is asking the court to order an immediate halt to operations at the facility until proper permits are obtained. It is also seeking financial penalties for each day the turbines were allegedly in violation of federal law, as well as mandatory pollution controls.
The filing noted that tens of thousands of people live near the site, and that a broader population in the Memphis area may be affected. It also raised demographic concerns, pointing out that a higher proportion of Black residents live in the impacted region compared to the national average.
xAI’s Expansion Plans Face Scrutiny
The legal challenge comes as xAI rapidly builds its infrastructure to support the growing demand for artificial intelligence computing power. The private company currently operates two data centers in Memphis and is planning a larger expansion in Southaven, including a permanent facility powered by 41 turbines.
Separately, the NAACP is urging Mississippi state regulators to revoke a March permit that allows further development of the project. They are also seeking penalties of up to $124,400 per day of violation and are requesting that the court order xAI to install proper pollution controls.
The dispute adds to mounting regulatory pressure on xAI, which is competing with major AI firms while navigating environmental and governance concerns tied to its rapid growth. The company has not yet publicly responded to the lawsuit.
