Artificial intelligence (AI) isn’t an artist, according to a new ruling from a federal appeals court. The court ruled against computer scientist Stephen Thaler, who is suing the U.S. Copyright Office for rejecting a piece of work created by his Creativity Machine AI. Today’s ruling upholds the initial decision that stood by the U.S. Copyright Office.

With this ruling, Thaler has failed to force the U.S. Copyright Office to recognize the Creativity Machine’s work, titled “A Recent Entrance to Paradise.” The U.S. Copyright Office argues a piece of art can’t be created solely by an AI and must have a human listed as its artist.

With recent AI advancements comes an increase in AI artists, individuals who provide prompts to AI to create works. There’s been plenty of controversy surrounding this practice as many generative AI models have been trained on traditional and digital artists’ works without their permission.

Is It Even Art If It Can’t Be Copyrighted?

Today’s ruling emboldens traditional and digital artists’ stance on AI works while dealing a blow to AI artists. It also prevents corporations from churning out AI works and copyrighting them. In short, it’s a win for human creativity.

A collection of artists has also sued Stability AI over the storage of their art in its Stable Diffusion model. The judge overseeing the case has allowed this allegation to move forward as a potential copyright infringement. Stability AI, Midjourney, DeviantArt, and Runway AI all use the Stable Diffusion model.

What This Means for AI Stocks

While the legality of many aspects of generative AI is still unclear, there’s no doubting the interest investors have in the market. This kicked off an AI boom last year that will likely last through 2025. As such, traders might consider taking stakes in AI companies. A few worth considering are Nvidia (NVDA), Amazon (AMZN), Meta Platforms (META), and Microsoft (MSFT).
