“The biggest threat in history to United States National Security would be a negative decision on Tariffs by the U.S. Supreme Court,” Trump said in a Truth Social post on Tuesday. “We would be financially defenseless.”

Trump Warns of $3 Trillion Loss as SCOTUS Weighs Tariffs

The IEEPA, passed into law in 1977, grants the president authority to impose tariffs in order to address a national emergency. Last month, the Supreme Court heard oral arguments for the case, although several justices appeared skeptical of the arguments by Trump’s legal team. Trump previously warned that the U.S. would take a $3 trillion hit, which includes “investments made, to be made, and return of funds,” if the court rules against him.

Betting markets are skeptical as well, with Polymarket pricing in 26% odds that Trump wins the case.
