A securities class action has been filed against Plug Power Inc., alleging the company misled investors about its plans and capacity to build hydrogen production facilities needed to access loan funding from the U.S. Department of Energy. The complaint claims that between January 17, 2025, and November 13, 2025, Plug Power’s public statements overstated the likelihood and scale of such projects, while the company was more likely to shift toward smaller initiatives with limited commercial potential.
According to the lawsuit, these alleged misrepresentations rendered Plug Power’s disclosures materially false and misleading during the class period, and investors incurred losses when the market adjusted to the perceived reality of the company’s hydrogen build-out strategy and related financing prospects.
