Kalshi’s regulatory conflict with Arizona escalated after the Commodity Futures Trading Commission (CFTC) secured a temporary restraining order halting the state’s criminal case against the prediction market operator. Arizona prosecutors have accused Kalshi of running an unlicensed gambling enterprise in the state, while the company operates under federal derivatives law overseen by the CFTC.

The CFTC, now led solely by Chairman Michael S. Selig following recent commissioner departures, argued that Arizona’s action undermines federal authority over regulated markets and could chill compliant firms through criminal enforcement. A federal judge had just allowed Arizona’s case to proceed before the restraining order was granted, highlighting a fast-moving jurisdictional clash that could affect Kalshi’s operating footprint, legal risk, and compliance strategy in multiple states.

Selig warned that using state criminal statutes against entities adhering to federal rules poses a “dangerous precedent,” signaling that the CFTC is prepared to actively defend its domain and the firms it supervises. The regulator simultaneously filed actions to block similar state-level proceedings in Connecticut and Illinois, underscoring that Kalshi’s legal exposure is not confined to a single jurisdiction and that the outcome could shape how prediction markets are classified and regulated nationwide.

For Kalshi, the temporary relief reduces immediate criminal risk in Arizona but does not resolve the underlying question of whether its markets are federally regulated derivatives or prohibited state gambling products.
