OpenAI has asked the attorneys general of California and Delaware to investigate SpaceX and Tesla (TSLA) CEO Elon Musk and his associates ahead of an upcoming trial for alleged “anti-competitive behavior.” The company is requesting an investigation of Musk’s actions, as it believes he has been trying to weaken its position in the artificial intelligence (AI) sector by several means.

OpenAI has accused Musk of engaging in actions the company termed “attacks” on its mission and operations. In a letter sent to the attorneys general of California and Delaware, the company’s Strategy Chief, Jason Kwon, claimed that Musk is attempting to weaken OpenAI’s position in the AI sector, thereby making the firm a less worthy competitor to other companies in the sector.
Kwon noted that such behavior will hinder OpenAI’s aim of developing artificial intelligence safely and responsibly in the U.S. He alleged that Musk has filed lawsuits, made public criticisms, and built a competing firm, xAI, that could significantly reduce fair competition in the AI sector. As a result, the company has now turned to the state regulators to investigate some of these actions ahead of the upcoming court trials.

The recent legal dispute is part of a long-standing conflict between Musk and Sam Altman, the CEO of OpenAI, who both co-founded the company in 2015. Musk left OpenAI in 2018 due to disagreement about the direction and structure of the AI model. However, in 2023, he launched xAI, which is now one of OpenAI’s major competitors.
Musk has filed lawsuits challenging OpenAI’s shift towards a strategy aimed at protecting its profits rather than maintaining its original non-profit mission.
