Microsoft (MSFT) CEO Satya Nadella took the stand in a California federal court on Monday to defend his firm’s deep financial ties to OpenAI, the creator of ChatGPT. Appearing before a judge in Oakland, Nadella addressed the lawsuit brought by Tesla (TSLA) CEO Elon Musk, challenging how OpenAI has evolved since its founding.

Nadella testified that he took pride in investing in OpenAI early, when most investors were still on the sidelines. He said the decision was a calculated risk, one that has since paid off handsomely for Microsoft and its shareholders.

Nadella Says OpenAI Deal Was Business, Not Charity 

As he took the stand to testify in court, Nadella was direct in stating that Microsoft’s deal with OpenAI was never philanthropic. From the start, he noted that the partnership was created for commercial reasons, not charity. He also said he was “very proud” to have invested in OpenAI. 

Even though Musk expressed concerns about the billions of dollars Microsoft poured into OpenAI, Nadella testified that the Tesla CEO never personally reached out to complain to him. Court records also showed that the partnership with OpenAI has been a huge success. While Microsoft invested over $13 billion long before tools like ChatGPT were famous, the deal had already brought in nearly $10 billion in profit.

Lawsuit Reveals Cracks In OpenAI’s Foundation

Notably, the ongoing trial has exposed deep divisions over OpenAI’s original mission as a non-profit firm. Musk argued on the stand that once Microsoft invested billions in OpenAI, the ChatGPT creator stopped focusing on its nonprofit mission to help humanity and started focusing on making a profit. He also accused OpenAI’s CEO, Sam Altman, and President Greg Brockman of filling their pockets at the charity’s expense. 

Because of this pressure, the two AI companies recently changed their contract to give themselves more flexibility in how they share cloud services and profits. Nadella also held firm that the partnership was vital for business, even though former board members testified about past fights over who was in charge and a failed bid to fire Altman. Now, the court has to decide if Microsoft’s investments really changed the legal rules OpenAI had to follow or had a major influence on its switch to a for-profit model.
