Royalties Inc. says its 88%-owned subsidiary Minera Portree de Zacatecas has received a recommendation from a Mexican Federal Prosecutor to deny Capstone Gold’s constitutional Amparo challenge over disputed Cozamin mine royalties. The prosecutor found no constitutional flaws in a Zacatecas appellate ruling that upheld MPZ’s 2% royalty rights on five Portree claims, a stance that has a historically low chance of being overturned by the Federal Court.
The company argues that a final ruling in MPZ’s favor would clear the way to quantify and collect an estimated US$10 million in unpaid royalties from 2019-2026, plus interest and damages. With sharply higher copper and silver prices, Royalties Inc. projects substantial future royalty cash flows from Cozamin, contending that proper payment since 2019 would have significantly increased its market capitalization and that the growing scale of obligations could become material for Capstone and its stakeholders.
