According to the memo dated March 6, the DoW told senior leaders that Anthropic’s artificial intelligence tools may continue to be used beyond a previously announced six-month phase-out if deemed critical to national security. Exemptions are limited to mission-critical operations, and units must submit a comprehensive risk mitigation plan.
The memo also directs Pentagon officials to prioritize the removal of Anthropic tools from systems supporting critical missions, including nuclear weapons and ballistic missile defense. To enforce the ban, contractors must certify full compliance within 180 days, and contracting officers have 30 days to notify them. Experts further warn that some Anthropic code may be hard to remove from deep software supply chains.
The federal government’s action is unprecedented, marking the first time a U.S. company has been designated a supply-chain risk. Anthropic remains the only AI company whose models are deployed on the Pentagon’s classified systems. After talks with Anthropic broke down last month, OpenAI signed a contract with the Pentagon, offering an alternative and highlighting the growing competition in military AI tools.
Anthropic’s Legal Dispute Continues
The dispute with the DoW escalated soon after Anthropic filed two lawsuits to block the ban, claiming Pentagon officials’ actions amounted to illegal retaliation and violated constitutional rights. The company said the actions were unauthorized. White House spokesperson Liz Huston responded, saying President Donald Trump would not allow companies to jeopardize national security.
Currently, Claude AI is deployed on classified Pentagon systems to assist with intelligence analysis. Its tasks include synthesizing patterns, summarizing reports, and surfacing relevant information faster than human analysts. Retired Navy Admiral Mark Montgomery said the AI processes roughly 1,000 potential targets per day, supporting strikes while humans remain in the loop.
